Welcome to DietGenie, a web platform that helps users create personalized meal plans based on their dietary preferences, goals, and personal details. By using our services, you agree to comply with and be bound by the following terms and conditions. These Terms of Service constitute a legally binding agreement between you and DietGenie.
2. Acceptance of Terms
By accessing or using DietGenie, by creating an account, by starting a free trial, or by purchasing a subscription, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these terms, do not use our services, do not start a free trial, and do not purchase a subscription.
You represent and warrant that you are at least 18 years old, have the legal capacity to enter into this agreement, and are using a payment method that you are authorized to use.
3. Description of Service
DietGenie is an AI-powered web platform that provides users with personalized weekly meal plans and shopping lists based on the information they provide through a quiz. Users can set goals such as gaining muscle, losing weight, eating healthy, or exploring new cuisines, and enter details like weight, weight goal, height, dietary restrictions, allergies, and medical conditions.
DietGenie is a digital content service. Meal plans, recipes, and shopping lists are generated on demand by artificial intelligence and delivered to your account immediately.
4. User Responsibilities
- Accuracy of Information: Users must provide accurate and complete information when taking the quiz. DietGenie is not responsible for any issues arising from incorrect or incomplete information.
- Personal Use: The services provided by DietGenie are for personal use only. Users are not permitted to resell, redistribute, or use the meal plans and shopping lists for commercial purposes.
- Account Security: You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
5. Health Disclaimer
- Not Medical Advice: The meal plans provided by DietGenie are generated by AI and are not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
- Consult Professionals: Users with specific health conditions, allergies, or dietary restrictions should consult a healthcare professional before starting any new diet or meal plan provided by DietGenie.
6. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
7. Intellectual Property
- Ownership: All content, including but not limited to text, graphics, logos, and software, is the property of DietGenie or its content suppliers and is protected by intellectual property laws.
- License: DietGenie grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the service for personal, non-commercial use.
8. Payment Terms, Free Trial, and Auto-Renewal
8.1 Subscription-Based Service
DietGenie operates on a subscription basis. Users can choose from various subscription plans with billing cycles ranging from weekly to yearly. The price and billing cycle of your selected plan are shown clearly on the checkout page before you confirm your purchase.
8.2 Payment Methods
Payments are processed through Stripe, our payment processor. We accept the payment methods supported by Stripe.
8.3 Free Trial
We may offer a free trial (typically 7 days) for new users. The length of the trial and the price that will be charged at the end of the trial are displayed on the checkout page before you confirm your purchase.
By starting a free trial, you expressly agree that:
- At the end of the trial period, your subscription will automatically convert to a paid subscription and your payment method will be charged the price disclosed at checkout, without further notice or action from you.
- You may cancel at any time during the trial to avoid being charged. Cancellation during the trial is free, takes effect immediately, and can be completed in one click from your account dashboard.
- If you do not cancel before the trial ends, you expressly authorize DietGenie and Stripe to charge your payment method for the full subscription amount.
8.4 Auto-Renewal
All subscriptions automatically renew at the end of each billing cycle at the then-current subscription price, unless you cancel before the renewal date. By subscribing, you expressly authorize DietGenie and Stripe to charge your payment method on each renewal date without further notice.
8.5 Cancellation Policy
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing cycle — you retain access to the service until then, and you will not be charged again.
Cancellation does not entitle you to a refund of the current billing cycle (see Section 8.6).
8.6 Refund Policy and Digital Content Consent
DietGenie is a digital content service. The moment a meal plan is generated on your account, the digital service is considered fully performed, delivered, and consumed.
By starting a free trial or purchasing a subscription and by generating any meal plan, you expressly consent to the immediate performance of the digital content service and expressly acknowledge that you thereby lose your right of withdrawal / cooling-off period to the extent permitted by applicable law, including:
- EU Directive 2011/83/EU on Consumer Rights, Article 16(m);
- United Kingdom Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, Regulations 36 and 37.
Accordingly:
- No refund will be issued once a meal plan has been generated on your account.
- Refunds may be issued at DietGenie’s sole discretion, and only if (a) you have never generated a meal plan, (b) you contact us at the address in Section 15 within 14 days of the charge, and (c) the request is made in good faith.
- Partial refunds for unused portions of a subscription period are not issued.
- Promotional, discounted, and annual plans are non-refundable once a meal plan has been generated.
8.7 Chargebacks and Disputes
If you believe a charge is incorrect, you agree to contact DietGenie first at the address in Section 15 and give us a reasonable opportunity to resolve the issue before initiating a chargeback, dispute, or reversal with your bank or card issuer.
Filing a chargeback without first contacting DietGenie, or filing a chargeback for a charge that was correctly authorized under these Terms (including a charge following a free trial you did not cancel, or a charge for a subscription period during which you generated a meal plan), is a breach of these Terms of Service. In such a case DietGenie reserves the right, without limitation, to:
- Contest the chargeback and submit to your bank evidence of your quiz responses, account activity, generated meal plans, login history, and your acceptance of these Terms;
- Immediately suspend or terminate your account and all associated subscriptions;
- Permanently block the payment method, email address, and IP address from any future use of DietGenie;
- Recover from you any chargeback fees, administrative costs, and reasonable legal fees incurred.
8.8 Promotions and Discounts
DietGenie may offer discounts and promotions from time to time. These are applied according to the terms specified at the time of the promotion and are non-transferable. Promotional pricing applies only for the period stated; thereafter, standard subscription pricing applies.
9. Limitation of Liability
To the maximum extent permitted by applicable law, DietGenie is not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with the use of our services. Our total aggregate liability to you for any claims arising from the use of the service is limited to the amount you have paid to DietGenie in the twelve (12) months preceding the event giving rise to the claim.
10. Changes to the Terms of Service
DietGenie reserves the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting on the website. Your continued use of the service after any changes constitutes your acceptance of the new terms. We will update the “Last updated” date below whenever the Terms change.
11. Termination
DietGenie reserves the right to terminate or suspend your access to the service at our discretion, without notice, for conduct that we believe violates these Terms of Service, for a chargeback or reversal filed in breach of Section 8.7, or for any other reason. Upon termination, your right to use the service ends immediately, and no refund is due.
12. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of Austria, without regard to its conflict of law rules. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Austria, to the extent permitted by applicable consumer protection law.
13. Marketing Communications
By creating an account or signing up for our services, you consent to receive marketing communications from DietGenie. These communications may include information about new products, services, promotions, and other updates that we believe may be of interest to you. You can opt out of receiving these communications at any time by following the unsubscribe link provided in our emails or by contacting us directly.
14. Entire Agreement and Severability
These Terms of Service, together with the Privacy Policy and any pricing disclosures shown at checkout, constitute the entire agreement between you and DietGenie with respect to the service. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
